Certified Email (PEC) is the new system through which it is possible to send emails with legal value equivalent to a registered letter with return receipt, as established by current regulations (DPR February 11, 2005, n.68).
This system is very similar to traditional email services but includes additional features that provide users with legal certainty regarding the sending and delivery (or non-delivery) of email messages to the recipient.

Certified Email has the same legal value as a registered letter with return receipt, including verification of the exact time of sending.

With the PEC system, the integrity of the content is guaranteed: the security protocols used prevent any modifications to the message content or attachments. In case of disputes, PEC ensures that the message can be legally opposed to third parties.

The term “certified” refers to the fact that the service provider issues a receipt to the sender, which constitutes legal proof of the message and any attachments being sent. Similarly, the recipient’s provider sends the sender a receipt of successful delivery.

Having a PEC is mandatory.
According to the new decree-law “DL 185/08,” converted into law n. 2 on 28/01/2009, companies, professionals, and public administrations are required to create and communicate a “virtual office”, identified by a PEC address, in addition to their traditional physical office.
